Introduction

This China Privacy Policy Addendum (the “InCareer Addendum”) provides additional disclosures required by local data protection law in the People’s Republic of China (“China”), which for purposes of this InCareer Addendum does not include Hong Kong, Macau or Taiwan.

The InCareer Addendum should be read in conjunction with the LinkedIn’s Privacy Policy (“Privacy Policy”), to describe the practices regarding the collection and use of personal information of InCareer members in China. It also describes how data is processed and shared in connection with InCareer Services (defined below).

InCareer is an online platform, including the InCareer application and website, operated by Beijing Lingyin Information Technology Co. Ltd. and powered by LinkedIn, which delivers a specialized experience in China, focusing on finding a job, finding a candidate, growing professional connections, or helping someone else find a job (“InCareer” or “InCareer Services”). If you are in China, you will participate in the InCareer Services via the InCareer platform. Beijing Lingyin Information Technology Co. Ltd. operates the InCareer platform in China and manages aspects of the InCareer Services pursuant to the Privacy Policy and regulatory requirements. Your InCareer account and data, including the data we collect, how we use your data, and how we share information, is subject to the Privacy Policy, unless otherwise stated in this InCareer Addendum.

1. Data InCareer Collects and Uses

As an InCareer member, your personal information will be collected and used in connection with InCareer features as follows:

Registration: To create an InCareer account, you need to provide personal information including your name, mobile number, email address, and a password. Your contacts may use your phone number and your name to invite you to connect on InCareer and grow their professional network.

Profile: Your profile helps you to get more value from InCareer, including helping recruiters find you. You may choose to share certain information on your InCareer profile, such as your education, work experience, photo, city or area. Your profile information is visible to your connections, recruiters, and other InCareer members. Guests of InCareer Services may also view your profile, consistent with your Public Visibility Setting. Subject to your Profile Discovery on LinkedIn settings and Profile Visibility on LinkedIn settings, your profile may be visible to and engaged with by LinkedIn members on LinkedIn Services (as defined in the InCareer User Agreement).

Resumes and Job Applications: If you submit a resume or fill out a job application on InCareer, the information will be shared with recruiters and potential employers at your direction (e.g., if you apply for a job) and will not be visible on your profile.

Messages: You may send, receive, or engage with messages or invitations to connect on InCareer. As explained in Section 1.6 of the Privacy Policy, we collect information when you use features like messaging. For example, if you get an InCareer connection request, we track whether you have acted on it and may send you reminders. We also maintain records of your communications with connections, with recruiters, and in response to job listings.

InCareer Services only collect and process your sensitive personal information when you choose to share it with us. We will use strict security measures when processing any sensitive personal information. Notwithstanding any statement to the contrary in the Privacy Policy, InCareer Services will not collect your address book or your precise location.

2. Sharing of Your InCareer Personal Information with Third Parties

For the purposes described in the Privacy Policy, InCareer may share your personal information as described below:

Profile: You may choose to share certain information on your profile, such as your education, work experience, photo, city or area. Your profile information is visible to your connections, recruiters, and other InCareer members. Guests of InCareer Services may also view your profile, consistent with your Public Visibility Setting. Subject to your Profile Viewing Options setting, we may let other InCareer members know when you view their profile. Subject to your Profile Discovery on LinkedIn settings and Profile Visibility on LinkedIn settings, your profile may be visible to and engaged with by LinkedIn members on LinkedIn Services.

Resume and Job Applications: If you submit a resume or fill out a job application on InCareer, the information will be shared with recruiters and potential employers at your direction (e.g., if you apply for a job) and will not be visible on your profile.

Enterprise Account: Your employer may offer you access to our enterprise InCareer Services such as Recruiter. Your employer can review and manage your use of such enterprise InCareer Services. Please see Section 3.1 of the Privacy Policy for more detail.

Related Services: We will share your personal information with LinkedIn’s affiliates, including those outside of China, to provide and develop the InCareer Services. Please see Section 3.4 of the Privacy Policy for more detail.

Service Providers: We engage others to help us provide the InCareer Services (e.g., maintenance, analysis, audit, payments, fraud detection, marketing and development). They will have access to your information as reasonably necessary to perform these tasks on our behalf and are obligated not to disclose or use it for other purposes.

InCareer also shares certain personal information with SDK service providers. Please find more information about our use of SDKs here.

Merger, division, dissolution and bankruptcy: If it is necessary for us to transfer personal information in case of a merger, division, dissolution, declaration of bankruptcy, or other reasons, we will notify you of the name and contact information of the recipient. The recipient shall comply with the Privacy Policy and this InCareer Addendum when processing your personal information.

Cross-Border Transfers of Your Personal Information: We provide the InCareer Services (as defined herein) through servers located in the United States, which means that, by agreeing to our User Agreement and this InCareer Addendum, you consent to the transfer of your personal information to the following countries and/or regions outside of China:

· Recipient: LinkedIn Corporation

· Country of the Recipient: United States

· Types of Personal Information: Section 1 of our Privacy Policy

· Purposes: Section 2 of our Privacy Policy

We will use lawful cross-border transfer mechanisms to transfer your personal information outside of China and adopt necessary measures to ensure the overseas recipients can provide the level of protection required under applicable Chinese laws.

If you do not agree to this cross-border transfer, we are unable to provide you the InCareer Services. At any time, you can export your personal information, delete portions of your personal information by editing your profile, or close your InCareer account and delete all of your personal information.

Other Services: When you bind the services provided by third parties with your InCareer account, we will share the corresponding information after obtaining or ensuring that the third party has obtained your consent.

3. Rights to Access and Control Your Personal Information Collection on InCareer

We offer you many Settings and options to control and manage the personal information InCareer processes about you. To manage the personal information that InCareer processes about you, please visit your InCareer account Settings. Specifically:

· To withdraw your consent for the collection, processing and sharing of your personal information, you can update your choices in Settings, edit your information in Manage My Activity, or directly edit your InCareer profile; and

· To withdraw your consent for the collection, processing and sharing all of your personal information or to delete your personal information entirely, you can close your InCareer account.

4. Modifications to this InCareer Addendum

We may modify this InCareer Addendum at any time and will post any changes on this page. If we make material changes to this Addendum, we will provide you with notice through the InCareer Services, such as through a pop-up window, app notifications, emails or SMS, as appropriate, to provide you with the opportunity to review such changes. If you object to any changes, you may close your InCareer account.

You acknowledge that your continued use of InCareer Services after we publish or send a notice about our changes to this InCareer Addendum means that the collection, use and sharing of your personal information on InCareer is subject to the updated InCareer Addendum, as of its effective date.

6. InCareer Mobile App Addendum- incl. List of Third Party SDKs

InCareer Mobile App Addendum provides additional disclosures required by the local data protection law for users in China. This should be read in conjunction with LinkedIn’s Privacy Policy and China Privacy Policy Addendum (“InCareer Addendum”) to describe InCareer Mobile App’s practices regarding the collection and use of the personal information of members residing in China.

The developer of the InCareer Mobile App is Beijing Lingyin Information Technology Co. Ltd., Room 817, 18F, Building 18, #1 DiSheng Bei Road, Beijing Yizhuang Development Area, China.

To ensure the implementation of particular product features and the safe and stable operation of the InCareer Mobile App, we may integrate third-party Software Development Kits (“SDK”) with our platform to provide particular product features and share necessary personal information with such third-party service providers. We will perform technical inspections, testing and behavioral audits on our own App as well as on third-party SDKs from time to time and require that they commit to compliance with applicable laws, regulations and agreements with us.
