Stauzeitkosten - Rechtsprechung im Licht der Ökonomie

Abstract
Im Rahmen des gezeigten Modells werden Stauzeitkosten ohne Staatseingriff vollständig von den Verkehrsteilnehmern getragen. Insofern gibt es – unter den getroffenen Annahmen – gegenüber nicht-Verkehrsteilnehmern keinen externen Effekt; die Durchsetzung des Verursacherprinzips erfolgt spontan. Die gleichgewichtige Strassennutzung ohne Staatseingriff ist jedoch ineffizient, da unter den Verkehrsteilnehmern Externalitäten bestehen. Unter geeigneten Bedingungen ist es (im Rahmen des vorgestellten Modells) möglich, die Verkehrsteilnehmer durch Besteuerung besser zu stellen, selbst wenn die Steuereinnahmen nicht rückerstattet werden. Gesamtwirtschaftlich effizient ist die Situation allerdings nur dann, wenn die Steuereinnahmen sinnvoll eingesetzt werden, z.B. in der Form einer pauschalen Rückerstattung.
