Les inconvénients d’un dépôt de brevet pour une entreprise innovatrice

Abstract
We study a problem of choice between patenting or keeping secret a process innovation in a duopoly game. We show that patent is the best choice for a mean innovation; but when the innovation is highly profitable, or on the contrary, when its profitability is low, the inventing firm is better off if not patenting. Le dépôt d’un brevet n’est pas nécessairement la meilleure façon de protéger une innovation. En effet, le monopole d’exploitation que confère un brevet est limité à une vingtaine d’années alors qu’en conservant son innovation secrète l’inventeur peut espérer garder l’exclusivité de sa technologie au-delà du terme légal d’un brevet.
