This image is irrevocably in the public domain, as it was first published before 1978 without a copyright notice in the 1959 issue of the Pennsylvania State University yearbook, LaVie. Although the "Reproduction notice" in the digitized version from September 2008 claims "All copyrights are held by the LaVie Board of Directors", no copyright notice appeared within the original 1959 publication. The rights, once they have lapsed into the public domain, cannot be revoked, and the image therefore is in the public domain. See also: w:Wikipedia:Public domain#Published works.
Note that it may still be copyrighted in jurisdictions that do not apply the rule of the shorter term for US works (depending on the date of the author's death), such as Canada (50 p.m.a.), Mainland China (50 p.m.a., not Hong Kong or Macao), Germany (70 p.m.a.), Mexico (100 p.m.a.), Switzerland (70 p.m.a.), and other countries with individual treaties.
