Radio station microphone images
[edit]Hi. I noticed that you've tagged the microphone images you've uploaded to Category:Country radio programs (like Image:KRUX.jpg) with {{PD-ineligible}}. I'd like to hear why you think this tag should apply: surely there's sufficient creativity involved in those images to make them eligible for copyright? - Hello, I think these images have no real content, there's only one little microphone and a combination of letters, nothing else. But if I should be wrong, there will be also the Template:PD-US-no notice, which also applies here. Many of them images are left without any copyright notice, often because the authors even didn't know about their rights or they didn't care about them things (the images I upload are in common older than 50 years). - Hmm... if you'd taken the pictures yourself, they might be PD per Ets-Hokin v. Skyy. However, that ruling also states that "Given the low threshold for originality under the Copyright Act, as well as the longstanding and consistent body of case law holding that photographs generally satisfy this minimal standard, we conclude that Ets-Hokin's product shots of the Skyy vodka bottle are original works of authorship entitled to copyright protection." Thus, at least based on that particular ruling, it seems likely that the photographer of those microphone images may hold (or have held) original copyright to them.
- As for the images having been published without a notice, I can't really say much about that: the only source you've given for the images is a website, hillbilly-music.com, which has no information (that I could find) regarding their original source. Certainly it seems possible that they may have been published without a notice, but without better source information it seems hard to prove that their original publication (presumably as part of promotional material?) did not carry a notice. IMO, unless more detailed source information can be obtained, that makes them questionable at best. —Ilmari Karonen (talk) 21:50, 21 October 2008 (UTC)

- I support Waylon. These images have been cropped down to the point there's literally nothing creative about them, a few letters and the dark blob of a microphone. No court in the world would find that creative enough for infringement to exist. -Nard the Bard 11:38, 23 October 2008 (UTC)

Wikimedia Commons has a specific scope

Please review our project scope, but in short, Commons is targeted at educational media files including photographs, diagrams, animations, music, spoken text and video clips. Wikimedia Commons does not contain text articles like encyclopedia articles, textbooks, news, word definitions and such. Each of these other kinds of content have their own projects: Wikipedia, Wikibooks, Wikisource, Wikinews, Wiktionary and Wikiquote.
If the content seems to fit the scope of one of those other projects, please consider contributing it there. If you think that the deletion was in error because the contribution really was in scope, you can appeal it at Commons:Undeletion requests, giving a reason why it fits our scope to help others evaluate the matter. Pay attention to copyright | The Wikimedia Commons does not accept fair use content, because fair use laws vary from country to country - thus, content deemed acceptable under, for instance, US fair use concepts (which are very broad) is not usable in the majority of other countries.
Also, fair use depends on the context the image (or other media) is used in. That is, something that can be used on one page as fair use would be a copyright violation on another page. Especially, fair use does not allow collecting and distributing the images in a media database such as the Commons. This means that fair use simply does not apply to the Commons.

Frank Ferera and other musicians
[edit]Hi. I've noticed you seem to be interested in Frank Ferera and some other musicians of that era. Are you familiar with the Bain News Service collection at the Library of Congress website. This is a collection of photos from the 1910s and 1920s done by a New York news service; the photos are now public domain and many have been scanned and are on the Library of Congress website. Unfortunately they are poorly catalogued, often only by a single key word, usually the last name of someone well known at the time seen in the photo, so they often don't turn up on specific searches of the LOC site. Anyway, I've been poking around with some of this and identified and uploaded some photos of early 20th century musicians and vaudeville stars. I entered "Ferera" at [1] and it turns up a series of 10 photos of 2 men. (one example.) I wondered if you could recognize if one of them is Frank Ferera, and maybe who the other guy is as well? - Hello Infrogmation, thank you very much for this link. I think, I will upload the Ferera images in the near future. I don't know who the guy is, but it could be Ferera's son Frank Ferera III or maybe also Ferera's late 1920s guitarist John K. Paaluhi. not a bot !!
[edit]A couple of things....
Many of the really great (or at the very least quite funny) audio files I enjoyed here have been uploaded by you and the images and the research for those. I can't do anything but thank you.
The other thing, I wanted to let you know that I re-established Category:RCA Victor because I looked and it still seemed to be active and it is interesting to me how record labels used to work.
Then, I had something happen. A sound recording which was supposed to be from 1990 of live music from an artist I bought a CD of in 1988 or 1989 saying that this CD was to be released for the first time on a completely different label "soon". English wikipedia, (the same source for RCA Victor still being active) claims that this CD was released under that wrong label.
Personally, I have a lot of history that I would like to re-write, but that is not the same as "getting over it" or "growing out of it" or "improving with age" or any of those other far more interesting things. On a lighter note, I have a theory that one day I woke up in the wrong universe and that CD of mine actually proves this. Love, physical & mental encounters, things you learn in high school and college, friends, lovers and enemies all come and go; but when you have to also purchase a new player to own some music and have the ability to play it whenever you want to -- experiences like this tend to have more of a lasting effect/memory. This one of mine, I have a hard copy of.
So, I am here, out of hatred and distrust of this incredibly stupid internet and the idiots that think that re-writing it will make things better (I think that there was more "verbal" appeal to say that it was "Warner Brothers" and not "Sony Records" -- which makes me dislike this internet and those who are so willing to "speak it"....
I am here to show you what I did and respectfully request that you look into the sub-categorization I have made of those old oggs and old record labels and repair anything that I might have gotten wrong or tell me the reasons to not keep the sub-labels separate so that I will not do this again. Logic sticks with me longer than cheesie strings, almost in spite of my claims of not being a bot.
But mostly, if you don't want to look into what I did (which is like work, perhaps) that's perfectly fine -- this is mostly a thank you for the upload of the audio files -- those that are still here.... -- Queeg (talk) 00:51, 19 June 2011 (UTC)

The reason given by the user who added this tag is: I am not an expert, please help... Rodgers version of "In the Jailhouse Now" was recorded February 15, 1928. (between 1923 and 1946 are copyrighted for a period of 100 ) this would make it PD in 2028. Is that important anyway? This is a recording of Webb Pierce from 1952. Jimmie Rodgers is dead 87 years !PD-old!. Does this overwrite everything else? If yes, why do we use the "PD-US-record" template?
