User:Intervex/Indigenous
Oh boy so it looks like very large numbers of First Nations & other Indigenous flags on this site have incorrect copyright tags. I'm gonna try and keep to the FNs living in what is now Canada & USA because this feels like a gigantic task.
Note: {{subst:npd}} recommended when there's a plausible author listed but no credible source it's actually PD/CC
When a digitizer improperly claims authorship, it's recommended to use {{subst:dw-nsd}} over regular NSD.
If source is missing but it's clearly PD: {{Source missing}} on the {{information|source=}} parameter
IMPORTANT: Looks like VisualFileChange.js, when sending notifications to uploaders, will send notifications to *everybody* who uploaded an version of the file in question. See: File:Flag of the Poarch Band of Creek Indians.svg it notified both the original uploader and another Commons user who uploaded an improved version of the SVG.
Note: registered copyright
NOTE Georgia Cherokee seal is copyrighted https://publicrecords.copyright.gov/detailed-record/18190668 https://georgiatribeofeasterncherokee.org/ which means that the SPECIES OF THE LAUREL matters for TOO
USA: Commons:Copyright rules by territory/United States
- Note https://tmsearch.uspto.gov is useful for confirming a flag's copyright registry or finding author info, because the copyright database doesn't have images or image descriptions, but the trademark office DOES.

Tripodero (perhaps is creator?). Given the historical importance of the flag I also started w:Wikipedia:Reference_desk/Humanities#Who_designed_the_flag_of_the_American_Indian_Movement_and_when?. Accurately credits Thomassie Mangiok. Can't find proof Thomassie Mangiok released it Creative Commons but all the news articles I've found on the flag seem to indicate he is trying to promote wide adoption and it's plausible enough to me that it's CC that I don't see enough reason to challenge it.

IDEAS FOR PREVENTION
edit- Commons:Bots/Work_requests#Sending_automated_messages_to_users_who_upload_suspicious_SVG_files_claiming_to_be_their_authors
- Similar bot idea: any SVG file uploaded that is in any of the children categories of Category:Symbols of indigenous peoples gets an automated message put on the user's talk page prompting them to double check copyright. (Maybe any image file that isn't a photograph? How to easily check if it's a photograph?)
- add some Indigenous examples to Commons:Threshold_of_originality#United_States_of_America
- and to Commons:Copyright rules by territory/United States
- and Commons:Copyright rules by territory/Canada
- adding info to Commons:Copyright_rules_by_subject_matter#Coats_of_arms
- create an actual section for Commons:Copyright_rules_by_subject_matter#Flags that isn't just a redirect to coats of arms
- add a paragraph to Commons:But it's my own work!
- add a paragraph to Commons:Own work
- write an equivalent of Commons:Scanning an image does not make it your "own work" for vectorizing and other file format conversions - pull in examples/discussion linked by Help:SVG#Copyright
- add some Canadian and other non-US examples of Indigenous flags to Commons:Threshold_of_originality#Logos_and_flags? Maybe the Nunavut case if it stays up?
DONE
- add some Indigenous examples to Commons:Threshold_of_originality#Logos_and_flags
